Commercial law encompasses the rights and obligations of economic entities, the state and other parties in relation to the economy, the way they are protected and regulated, as well as regulations relating to the market, competition, labour relations, financing, investment, privatization and other economic activities.

The Law on Business Entities provides that economic activities in Serbia can be carried out either as sole proprietors or as business entities. Among business entities, on one side, there are partnerships such as general partnership and limited partnership, and on the other side, there are capital companies such as limited liability company and joint-stock company.
